10-6-12-6: RESERVATION OF POWERS:
Nothing in this section 10-6-12 shall be construed as prohibiting the city from providing for bus stops, for taxi stands or other matters of a similar nature, including the loading or unloading of trucks, vans or other commercial vehicles and the issuance of courtesy tickets or permits. (Ord. 691, 7-20-1981)
10-6-12-7: VIOLATIONS:
It shall be unlawful an a violation of the provisions of this section 10-6-12 for any person:
   (A)   To cause, allow, permit or suffer any vehicle registered in the name of or operated by such person, to be parked overtime or beyond the period of legal parking time established for any parking space as herein described.
   (B)   To permit any vehicle to remain or be placed in any such parking space beyond the period prescribed for such parking space. Any vehicle continuing to occupy such space after issuance of an initial notice of violation shall be in continuing violation and such person shall be subject to a separate charge for each two (2) hour period his vehicle remains so parked. 10-6-12-8: PENALTY:
Any person whose vehicle or motor vehicle shall violate or fail to comply with any of the provisions of this section 10-6-12 shall be deemed guilty of an offense and shall be punished by a fine of not less than ten dollars ($10.00) nor more than three hundred dollars ($300.00). It is intended that this is the absolute liability of the person whose vehicle or motor vehicle is found to have violated this section 10-6-12, unless that person can conclusively prove that the vehicle was at the time of the violation stolen or similarly beyond the registered owner's custody or control. 10-6-13: TRAILER PARKING PROHIBITED:
   (A)   No Trailer Parking: No person shall park a trailer on any public street, avenue, boulevard, alley or other public right of way within the City, except temporarily for a period of time not to exceed seventy-two (72) hours in any consecutive seven (7) day period. Any trailer parked in violation of this section may be removed, at the owner’s expense, pursuant to Sections 6-7-1 through 6-7-6 of this Code.
   (B)   Penalty: A violation of this Section shall be assessed the following fine(s):
      1.   First offense: No less than a one hundred dollar ($100) fine.
      2.   Second offense: No less than a two hundred dollar ($200) fine.
      3.   Third offense: A three hundred dollar ($300) fine and the trailer may be subject to removal and impoundment. (Ord. 898, 2-21-2017; amd. Ord. 924, 7-5-2022)
10-6-14: TRAILER AND RECREATIONAL VEHICLE PARKING:
   (A)   Snowmobiles, boats, or other recreational vehicles and campers, camper trailers, or motor homes must be parked in a rear yard unless the rear yard is inaccessible. In that case, a trailer or recreational vehicle may be parked in a front or side yard as long as it is on a surface prepared with asphalt, concrete, gravel, or pavers.
   (B)   Snowmobiles, boats, or other recreational vehicles and campers, camper trailers, or motor homes must be parked in a rear or front yard must meet setback requirements as follows:
      1.   Such a vehicle shall be parked with at least a five-foot separation between such vehicle and any door, window, or other opening of a dwelling or accessory building that provides ventilation or access to the structure; and
      2.   Open storage and off-street parking of licensed and operable recreational vehicles in any yard shall provide setbacks to property lines at a minimum of:
         a.   Three (3) feet to a side or rear property line; and
         b.   Eight (8) feet from the back of a sidewalk.
         c.   If no sidewalk exists, all measurements shall be made from the front and side of such a vehicle adjacent to street property lines.
   (C)   Campers or recreational vehicles stored on residential property may not be used for living or sleeping purposes for more than five (5) consecutive days. (Ord. 925, 7-5-2022)
