A person commits an offense if he:
(A) Knowingly or intentionally smokes in a place described in § 94.20 of this subchapter.
(B) Is the department head or supervisor, or other person in charge of a public place and knowingly or intentionally permits or fails to make a reasonable effort to prevent commission, by another, within such public place, of the offense described in division (A) of this section.
