§ 713. Definitions.
The following words and phrases, when used in this Part, shall have the meanings indicated hereinbelow, except where the context clearly indicates or expressly requires a different meaning.
   EMERGENCY INCIDENT - an occurrence involving a risk of harm and/or eminent threat to private or public property, life or potential threat to the environment or public health or safety including, but not limited to, the following:
      (1)   Unfriendly fires, i.e., fires that are not under the control of the property owner or occupant or fires that threaten adjacent property.
      (2)   Vehicle accidents where there is a report of injuries.
      (3)   Vehicle accidents where petroleum or hazardous materials or chemicals are spilled or released or where there is a threat of such spillage or release.
      (4)   Vehicle accidents where traffic control is required.
      (5)   The occurrence of a building, well, trench or sinkhole collapse requiring rescue efforts or otherwise threatening life, property or the environment.
      (6)   The release or spillage of petroleum or hazardous material or chemicals.
      (7)   The occurrence of any incident within the Township which requires traffic control requested by the Township fire personnel or the State Police.
   EMERGENCY SERVICE COSTS - all direct and indirect costs, expenses incurred/expended by the Han-Le-Co Fire Company in connection with any emergency incident including, but not limited to, the following:
      (1)   The reasonable hourly value of volunteer personnel, as determined by the Han-Le-Co Fire Chief, taking into account the funds expended to train and properly equip each such volunteer, times the number of hours worked by each such volunteer, less one hour in response to any emergency incident.
      (2)   The costs of all non-reusable materials and all contaminated or consumed material utilized in connection with any emergency incident.
      (3)   The costs of all equipment, calculated by estimating the number of hours of the useful life of such equipment and dividing same into the replacement costs plus the maintenance costs of said equipment and then multiplying the result by the number of hours such equipment was "in service" in response to any emergency incident.
      (4)   The administrative costs of recording, keeping information, processing, assembling and transmitting a bill of costs.
   FALSE ALARMS - any oral, electronic or mechanical communication to Han-Le-Co Fire Company indicating that a fire or other emergency incident warranting immediate action by Han-Le-Co Fire Company has occurred or is occurring. This shall include a communication made to the County Control Center if the content of the communication is then forwarded to Han-Le-Co Fire Company. A false alarm shall not include any activation of an alarm system due to any malfunction caused by a violent, natural catastrophic condition including electrical storms or power outage or conditions beyond the alarm owner or user. Notwithstanding the foregoing, an accidental activation of an alarm system shall constitute a false alarm when caused by the negligence of the alarm owner or user or their agents or others permitted on the property of the alarm owner or user.
   RESPONSIBLE PARTY/PARTIES - the following persons or business entities shall, for the purpose of this Part, be deemed responsible parties:
      (1)   The owner and/or operator of a motor vehicle involved in an emergency incident.
      (2)   The owner and/or occupant of real property on which an emergency incident occurs.
      (3)   The owner of petroleum or hazardous material or chemicals involved in an emergency incident.
      (4)   Any person(s) and/or legal entity, or entities, found to be legally responsible in any court of competent jurisdiction for the causation of any emergency incident.
