1. Any person who is the owner or lessor of premises on which hazardous materials are kept, stored, located and which premises are not labeled in accordance with this Part shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than three hundred ($300.00) dollars or by imprisonment of not more than ninety (90) days as provided in the appropriate court for each offense. Each day that a violation continues after one (1) year and after receipt of notice as provided in this Code, shall be deemed a separate offense.
2. Any person who owns or possesses a container of hazardous materials not labeled in accordance with this Part shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than three hundred ($300.00) dollars or by imprisonment of not more than ninety (90) days as provided in the appropriate court for each offense. Each day that a violation continues after one (1) year and after receipt of notice as provided in this Code, shall be deemed a separate offense.
