§ 209. Prohibition of Brake Retarders.
   1.   Engine Brakes Prohibited. No motor vehicle, defined to be a vehicle which is self-propelled except an electric personal assistive mobility device or a vehicle which is propelled solely by human power pursuant to Pennsylvania Motor Vehicle Code (Pennsylvania Title 75, Part I, Chapter I, Section 102), shall be operated on the streets, roads, alleys or highways (herein "streets") listed in Section 2, below, within Hanover Township, Lehigh County, Pennsylvania, utilizing, in said operation, an engine brake or engine suppression or compression brake.
   2.   Streets. The streets subject to this prohibition shall be as follows:
      a.   State Route 1004 known as Race Street beginning at the Hanover Township boundary adjoining the Borough of Catasauqua, Lehigh County, Pennsylvania and continuing eastward to the intersection with State Route 987 known as Airport Road for eastbound traffic.
      b.   State Route 1004 known as Race Street beginning at the intersection with State Route 987 known as Airport Road and continuing westward to the Hanover Township boundary adjoining the Borough of Catasauqua, Lehigh County, Pennsylvania for westbound traffic.
      c.   State Route 1003 and State Route 987, both known as Airport Road beginning at the Hanover Township boundary adjoining the City of Allentown, Lehigh County, Pennsylvania and continuing northward to the intersection with State Route 1009 known as Schoenersville Road for northbound traffic.
      d.   State Route 1003 and State Route 987, both known as Airport Road beginning at the intersection with State Route 1009 known as Schoenersville Road and continuing southward to the Hanover Township boundary adjoining the City of Allentown, Lehigh County, Pennsylvania for southbound traffic.
   3.   Emergency Situations. This ordinance shall not apply to emergency driving situations requiring the utilization of an engine brake to protect the safety and property of the residents of Hanover Township, other motor vehicle operators, pedestrians, and the operator and passengers of the motor vehicle involved in said emergency situation.
   4.   Penalty for Violation. Any person, corporation, partnership or legal entity violating any of the provisions of this Section shall, upon conviction thereof, be sentenced to pay a fine of not more than three hundred ($300.00) dollars and costs of prosecution, and in default of the payment thereof, shall be sentenced to undergo imprisonment for a period not to exceed ninety (90) days. Every occasion that a violation under this ordinance occurs shall constitute a separate offense.
