§ 602. Defintions.
The following words and phrases, when used in this Part, shall have the meaning ascribed to them in this Section, unless the context clearly indicates otherwise:
   COMMERCIAL PARKING PLACE - any place indoors or outdoors within the territorial limits of the Township, where the general public or a limited or selected number thereof, may park or store a motor vehicle for any period of time in exchange for the payment of the established price, and which has sufficient space for the parking or storing of at least ten (10) motor vehicles.
   ESTABLISHED PRICE - the total monetary charges of any character whatever, including donations, contributions, dues or membership fees (periodical or otherwise), plus the total monetary value of charges of any character whatever in a form other than money (including property bartered or services rendered), fixed, exacted or collected by an operator, or in any manner paid by a person to an operator, for the privilege of parking or storing a motor vehicle at or in a commercial parking place.
   EXEMPT OPERATOR - any operator which:
      (1) Asserts that the Township does not have legal authority to require the operator to collect the tax imposed under this Part;
      (2) Refuses to collect the tax imposed under this Part; and,
      (3) The Township relieves from the obligation to collect the tax imposed under this Part.
The Township may rescind the relief granted under subsection (3) at any time, upon three (3) months written notice to the operator, if the Township desires to challenge the operator's assertion under subsection (1).
   OPERATOR - any person operating a commercial paring place and/or directly or indirectly charging or receiving money or other property or services in exchange for granting members of the general public or a limited or select number thereof the putative right to park or store a motor vehicle on property owned, leased or possessed by such person.
   PERSON - an individual person, copartnership, association, unincorporated enterprise or corporation, domestic or foreign. Whenever used in any provision imposing a penalty, the term "person" as applied to corporations shall mean both the corporation and the officers thereof, and as applied to partnerships or unincorporated associations shall mean both the entity and the managing partners or members thereof (or in the absence of such managing persons, all of the partners or members thereof).
   RESIDENTIAL PARKING TRANSACTIONS - the payment of a monetary fee and/or the transfer of anything of value by any person to an operator for the privilege of parking or storing a motor vehicle at the residence of such person or within three hundred (300) feet of the principal residence of such Person.
   TOWNSHIP - Hanover Township, Lehigh County.
   TREASURY DEPARTMENT - the Treasury Department of the Township.
