§ 1-797.4. Sexual Harassment Policy.
   1.   Sexual harassment in the workplace is a form of employment discrimination. It is the policy of Hanover Township that sexual harassment of employees or applicants for employment is strictly prohibited and will not be tolerated. Under this policy, all employees share the responsibility for assuring that the workplace is free from all forms of sexual harassment.
   2.   Sexual Harassment includes unwelcome sexual advances, request for sexual favors and/or other verbal or visual or physical conduct of a sexual nature where:
      A.   Submission to such conduct is made either explicitly or implicitly a term or condition of an individual's employment.
      B.   Submission to or rejection of such conduct of an individual is used as a basis of employment decisions effecting such individuals.
      C.   Such conduct has the purpose or effect of unreasonably interfering with an individual's work performance or creating an intimidating, hostile or offensive working environment.
   3.   Such conduct may also include action by members of the employee's own sex. Thus, no manager, supervisor or other employee shall threaten or suggest, either explicitly or implicitly, that another employee or applicant's refusal to submit to sexual harassment in any form will adversely affect that person's employment, performance evaluation ratings, wages, compensation, advancement, assigned duties or any other term or condition of employment. In addition, offering, promising or granting favored treatment to any other employee or applicant for employment as a result of that person's engaging in or agreeing to engage in sexual conduct as well as seeking in any way to make the performance of a person's job more difficult because of that person's sex or the refusal of that person to submit to sexual advances is strictly prohibited.
   4.   The following behavior is also prohibited: physical assaults of a sexual nature, other unwanted and unnecessary contact with another employee, unwelcomed propositions or sexual flirtation, direct or subtle pressure or requests for dates of sexual activity, verbal abuse of a sexual nature including, but not limited to, inappropriate verbal comments about an individual's body or sexual activities, the inappropriate use of sexually explicit or offensive language in discussions with or to describe an individual, sexually explicit offensive jokes and the display in the workplace of sexually suggestive objects or pictures.
