§ 1-774.   Testing Procedures and Requirements.
All affected Township employees and applicants shall be tested according to the following procedures:
      A.   Preemployment. All applicants for employment shall be tested for drugs prior to acceptance for employment by the Township. Any applicant tested positive shall not be considered for employment. Any refusal or failure by the applicant to submit to these such tests shall be deemed a positive result.
      B.   Random. All Township employees subject to the drug and alcohol policy will be tested for the above drugs on a random basis and without any advance notice. Testing shall be done not less than on a quarterly basis. The number of employees annually selected shall be at least 50% of the employees for drug testing and 25% of the employees for alcohol testing.
      C.   Reasonable Cause. Any employee giving reasonable cause to believe that he or she is in violation of the policy established in § 772 shall be subject to testing immediately upon observation of such reasonable cause by supervisory personnel. The reasonable cause shall be limited to behavior or conduct observed at the work place or en route to a work place during working hours. Observation shall be by supervisor personnel who have received at least 1 hour of training in drug use detection and 1 hour of training in alcohol use detection. Supervisory personnel making reasonable cause observations shall make and file with the Township a written report of the attendant circumstances. Such reports shall be confidential.
