1. Location and design standards for all modes of access except as hereinafter described shall comply with the current Zoning Ordinance and/or Subdivision and Land Development Regulations, and a street occupancy permit shall be obtained.
2. Location and design standards for all modes of access onto Legislative Routes shall comply with the current PennDOT Driveway Regulations and a PennDOT Highway Occupancy Permit shall be obtained.
3. With respect to driveways'or other modes of access onto Legislative Routes, the Township Engineer may make recommendations to PennDOT regarding traffic safety, storm drainage, etc.
4. Driveways from private property onto existing alleys -- whether or not open to traffic--must be authorized by a Street Occupancy Permit except that no permit fee shall be charged and such driveways shall not be regulated by Parts lA and 1B unless otherwise determined by the Inspector.
5. Driveways from private property onto privately owned subdivision streets which are intended to remain private streets in mobile home parks, industrial parks, schools, apartment projects, shopping centers, etc., must be authorized by a Street Occupancy Permit except that no Occupancy Deposit shall be required.
6. Existing driveways which do not conform to this Part because of width, location, grades, etc., shall be brought into compliance at or before the time that the Township orders high grade street pavement and/or curbs and/or sidewalks constructed unless the applicant applies for and is granted a relaxation of these standards.
7. The opening of unaccepted paper streets or alleys onto existing streets must be authorized by a Street Occupancy Permit.
8. Location and design standards for private road for motels, shopping centers, mobile home parks, apartment projects, etc., shall comply with the Zoning Ordinance and Subdivision Regulations.
9. It is anticipated that certain streets in the Township, designated in the Zoning Ordinance as Collector and Arterial Streets, will in the future have both wider cartways and right-of-ways. In some cases, the existing legal right-of-way width is only 33 feet. It is the intention of the Township Council that driveways not be authorized on certain of these streets unless the property owner signs a statement acknowledging that his proposed driveway pavement must be considered a temporary pavement, a portion or all of which may need to be replaced when the street is reconstructed and widened. Additionally, this statement will make it clear that the Township's issuing the driveway permit is not to be construed as a financial obligation of the Township to reconstruct the subject's driveway at the time of reconstruction or widening the street.
10. The Township in its discretion may make inspections of the construction of driveways to insure compliance with these regulations.
11. The Township Manager, in his discretion, may authorize studies of traffic, storm drainage, etc., before an Occupancy Permit for a given driveway is issued.
12. Where existing concrete curbs must be "removed" for a new driveway or other construction, replacement shall be in accordance with the Township Curb and Sidewalk Specifications.
