§ 101. Definitions.
The following words or phrases when used in Parts 1A and 1B shall have the meaning ascribed to them in this section unless the context clearly indicates otherwise. Also, personal pronouns shall include the singular as well as the plural number and the male, female and neuter gender.
   ACCESS - any means for passage of vehicles between property abutting a street and the street. It shall be deemed to include only that portion of the driveway or access road that lies within the established right-of-way limits of the street.
   APPLICANT - any person who makes application for a permit under the provisions of Part lA and 1B.
   CONSTRUCTION - the building, putting together, or placing of any materials upon, through, or over the street, curb, sidewalk or areas within the right-of- way of any alley or lane within the Township which could interfere with the public's use of said street or sidewalk.
   EMERGENCY - any unforeseen circumstances or occurrence, the existence of which constitutes a clear and immediate danger to persons or properties.
   ERECTION OF OBSTRUCTION - the putting together, building, or placing of any materials upon, through or over the street, curb, sidewalk or areas within the right-of-way of any street, alley or lane within the Township which could interfere with the public's use of said street or sidewalk.
   EXCAVATION or EXCAVATIONS - the digging of any trench or excavating through or under the street, curb, sidewalk, or right-of-way or the cutting into or opening and removal of any of the pavement surfaces, curbs or sidewalks within the right-of-way of any said street, curbs or sidewalks within the Township.
   INSPECTOR - the person designated by the Township Manager to monitor street excavation and construction on behalf of Hanover Township.
   PERMITTEE - any person who has been issued a permit and has agreed to fulfill all terms of this Part.
   PERSON - shall mean and include any natural person, partnership, firm association, utility, corporation, or authority created pursuant to an act of the Pennsylvania General Assembly. Whenever used in any section prescribing and imposing a penalty, the term “person” as applied to Associations, shall mean the partners or members thereof and as applied to a corporation, the officers thereof.
   PUBLIC UTILITY COMPANY - any company subject to the jurisdiction of and control by the Pennsylvania Public Utility Commission or the Federal Communica tions Commission.
   STREET - shall mean and include any street, public easement, right-of-way, highway, alley, way or road in the Township.
   STREET OCCUPANCY - the excavation, construction, erection of obstructions or the establishment of any access from abutting property to a street, which access will be used by vehicles as driveway or means of ingress or egress to said streets.
   STREET OPENINGS - any excavation, construction, or erection of obstructions within the right-of-way of Township streets which do not fall within the definition of street occupancy.
   TEMPORARY MEMORIAL DISPLAY - a group of flowers, pictures or other objects placed at a location in remembrance of an individual. [Ord. 482]
