1. Procedure. In the event of a disagreement between the Township and an employee, the employee may file a grievance in writing. Within 72 hours after receiving the employee's written grievance, the Township Manager will then forward the written grievance to the Personnel Board, who will within 10 work days after receipt from the Manager respond in writing to the employee's grievance, agreeing or disagreeing with the employee's appeal and explaining the reason why. A copy of the board's decision will also be sent to the Township Manager. If the employee or Township Manager disagrees with the Personnel Board's decision, or if the Board fails to respond, either may, by the next regularly scheduled meeting, submit his grievance to the Hanover Township Council who shall either agree or disagree with the Personnel Board's decision. The Township employee and Manager will receive a reply in writing from the Council 3 work days after such scheduled meeting.
2. If a CDL employee shall have a grievance regarding:
A. His dismisal or discipline by the Township Manager for violation of the Township's Drug and Alcohol Policy and Testing Program, Stat. Code, Chap. 1, § 770 et seq., or a positive test result thereunder; or,
B. The Township's administration of the aforesaid Drug and Alcohol Policy and Testing Program;
the employee must submit his grievance directly to the Hanover Township Council at its next regularly scheduled meeting, instead of submitting his grievance to the Personnel Board. The Council shall respond and send notice of its response as provided in Subsection (1) to this Section. For purposes of this subsection, the phrase "next regularly scheduled meeting" shall mean the first Council meeting occurring more than 72 hours after the administrative act or omission which allegedly causes employee's grievance.
3. Employee's Status During Grievance Procedure. If the employee's grievance concerns a reprimand, suspension, demotion or dismissal by his supervisor, such reprimand, suspension, demotion or dismisaal shall remain in effect during the grievance procedure. Invocation of the grievance procedure in no way acts as a supersedeas of the supervisor's action.
