§ 106. Enforcement of Regulations and Orders of Township.
   1.   Failure to Comply with Requirements of this Part. If any property owner shall fail to comply with the requirements of this Part for the planting, trimming and/or removal of a shade tree, street tree or other tree and shall continue in a noncompliance for a period of thirty (30) days after written notice, the Township may undertake to perform such planting, trimming and/or removal, to bill the property owner for the costs of the same as certified by the Township Engineer and filed with the Township Clerk.
   2.   Written Notice of Cost. Upon the filing of the Township Engineer's certification, the Township Clerk shall cause thirty (30) days written notice to be given to the person against whose property an assessment has been made. Said notice to be given by certified mail, return receipt requested. The notice shall state the amount of the assessment and the time and place of payment and shall be accompanied by a copy of the certification of the Township Engineer.
   3.   Filing of Municipal Lien. The amount assessed against the real estate shall be a lien from the time of the filing of the certification with the Township, and if not paid within the time designated in the notice, a claim may be filed and collected by the Township Manager in the same manner as municipal claims are filed and collected.
   4.   Alternative – Action in Assumpsit. Nothing contained herein shall restrict the Township from collecting said costs by an action in assumpsit.
