(A) Hawkers and peddlers. Every person convicted of violating any of the provisions of §§ 116.001 through 116.009 shall be punished by a fine of not to exceed $100 and costs of prosecution and, in default of the payment of the fine and costs, the court may make a further sentence that the offender be imprisoned in the Wayne County Jail, or another place of imprisonment as may be hereafter established by the City Council as a place of confinement, until the fine and costs be paid, but not longer than 90 days, or, in the discretion of the court having jurisdiction of the cause, both a fine and imprisonment may be imposed.

(B) Transient merchants. Every person, firm, copartnership, association or corporation convicted of violating or failing to comply with the provisions of §§ 116.020 through 116.026 shall be punished by a fine not to exceed $100 and costs of prosecution, or by imprisonment not to exceed 90 days, or by both a fine and imprisonment in the discretion of the court and when a fine and costs are imposed the court may provide that in default of the payment thereof, the offender shall be imprisoned for a period not to exceed 90 days, unless the fine and costs shall be sooner paid; provided, no person shall be imprisoned for a single violation of §§ 116.020 through 116.026 for a longer period than 90 days. In the event that there shall be imposed upon any corporation any fine or costs, or either, or both, for the violation of any terms of §§ 116.020 through 116.026 then it shall be lawful to collect the fine and costs, or either, or both, in any action or assumpsit before any court of competent jurisdiction.
