§ 101.016 SALES OR DISTRIBUTION OF LITERATURE ON PUBLIC STREETS OR PROPERTY.
   (A)   No person shall sell any merchandise or distribute any literature or flyers on any street within the city, on any traffic island or median in the city or on public or private property within 200 feet of any intersection in the city.
   (B)   This section in no way modifies the licensing provisions of Chapter 122, “Peddlers, Hawkers and Transient Vendors” and those provisions shall remain in full force and effect. This section shall not be applicable to adult newspaper hawkers selling newspapers on Sunday or other periodical/newspaper vending machines which do not obstruct motorists’ views or otherwise detract from public safety and welfare.
   (D)   This section does not or shall not be applicable to the Hammond Fire Department or the Hammond Firefighters’ Union seeking donations of charitable cause on any day of the week.
   (E)   Newspapers and the firefighters must go before the Board of Public Works and Safety to get a proper permit, whether it’s for the sale of newspapers or for their fundraising efforts.
   (F)   Violations of this section shall be enforced by the Police or Code Enforcement Departments pursuant to the general penalty § 10.99.
