§ 101.015 SOLICITATION BY PEDESTRIANS ON OR ABOUT PUBLIC STREETS OR WAYS.
   The following guidelines shall be met by organizations requesting permission to solicit funds on public thoroughfares:
   (A)   There shall be no solicitation of funds, donations or other gratuities or sale of items by any pedestrian on, upon or adjacent to the public streets and ways of the city to or from the operators of occupants of motor vehicles being driven upon those streets and ways, except as provided in division (B) of this section. The sale of items may occur adjacent to the public streets only if the seller is a registered and license business and such sale is occurring in front of or adjacent to the licensed business’ regular place of operation.
   (B)   Solicitation shall be authorized by the Board of Works on the following basis:
      (1)   Such shall only be permitted on the second and fourth Thursday, Friday and Saturday during the months of April, May, June, July, August, September and October;
      (2)   Such shall be limited to formally organized philanthropic, service and your organization which originate in the city;
      (3)   Such shall be limited to 1 organization per day on a first come, first serve basis;
      (4)   Only intersections with median :strips shall be used for solicitation of funds or donations or other gratuities;
      (5)   Organizations shall provide proof of insurance naming the City, as additional insured in minimum amounts of $500,000 per person and $1,000,000 per incident; and
      (6)   In addition to the requirements set forth in this division (B)(6), divisions (B)(1) through (B)(4), those organizations shall make public application with the Chief of Police, who will forward the request to the Board of Public Works and Safety for approval, at least 4 weeks prior to the date requested; shall not solicit prior to 8:00 a.m., or after 4:00 p.m.; persons involved shall wear reflective vests and shall not impede traffic; any person involved under the age of 18 shall be accompanied by an adult sponsor over the age of 21; and the party requesting the date for the organization shall provide a telephone number and list of locations to be worked at.
   (C)   It shall be the responsibility of the Police Department, assisted by the Code Enforcement Department to enforce the provisions of this section.
