(A) Fermenting, putrefying or odoriferous garbage dumped in the open, or in uncollected containers due to improper type, placing or maintenance of containers shall be declared a nuisance.
(B) The penalty for maintaining such a nuisance as is described in division (A) above shall be a fine in an amount not exceeding $1,000. Each day that any person shall violate any of the provisions of this section shall constitute a separate offense and shall be punished as a separate offense.
