§ 93.063 LICENSE REQUIRED.
   (A)   For the purposes of this subchapter, operators and salespersons of fireworks stands are deemed “transient merchants,” as that term is defined in § 122.01. Before June 20 of each year, the owner or operator of a fireworks stand shall obtain a transient merchant’s license. No sale of fireworks may be made within the city before the license is obtained. The license shall be obtained in accordance with Chapter 122, except that the application fee (because of the number of inspections involved and the surveillance necessary to protect the people of the city) for a transient merchant’s fireworks stand license shall be $25. Once a license has been obtained, it shall be prominently posted at the fireworks stand, so that it is easily visible to the public.
   (B)   The City Controller’s issuance of a transient merchant’s license for a fireworks stand does not constitute approval of the fireworks offered for sale by the retailer. The retailer is responsible for determining that all fireworks which he or she offers for sale conform to applicable law.
