(A) Requirement. Any person or company operating as a motor vehicle repossession agent in the city is required to have a city business license to operate within the city limits.
(B) Fees. There shall be a fee of $100 per annual license.
(C) Application. There shall be an application for license containing the following information:
(1) Name and business address of applicant;
(2) History of criminal convictions of applicant;
(3) Proof of valid driver’s license or operator’s license for applicant; and
(4) Proof of insurance for applicant for any vehicle driven.
(D) Control and conditions. City business licenses are controlled by Chapter 119 of the city code and all terms and conditions of that chapter shall apply.
(E) Operation in city. A motor vehicle repossession agent who repossesses or intends to repossess a motor vehicle or watercraft, and can do so without breaching the peace, must provide the following information to the Hammond Police Department before the repossession takes place, or not later than 2 hours after the repossession occurs:
(1) The identity of the repossession company;
(2) The identity of the repossession agent, with photo I.D.;
(3) The name and address of the person believed to be currently in possession of the motor vehicle or watercraft in the city;
(4) The name and address where the motor vehicle repossession agent believes that the motor vehicle or watercraft will be found in the city;
(5) A copy of the order of repossession issued by a judicial entity or proof of a debt instrument and security agreement showing evidence of default by debtor; and
(6) Any other document/condition as directed by the Chief of Police.
(F) Penalty. See § 10.99. Each day constitutes a separate violation. Violation of any provision of this section is grounds for revocation of license.
