§ 37.113 REFUSAL TO SUBMIT.
   (A)   An employee may not refuse to submit to a post-accident, random, reasonable suspicion, or follow-up alcohol or controlled substances test required by the regulations. An employee who refuses to submit to such tests will be immediately terminated and considered to have tested positive for drugs or failed an alcohol test.
   (B)   Refusal to submit includes failing to provide adequate breath or urine sample for alcohol or drug testing and any conduct that obstructs the testing process. This includes adulteration or substitution of a urine sample.
