§ 101.165 PROHIBITED CONDUCT.
   (A)   It shall be unlawful for any person, organization, group, corporation, property owner, tenant, or business to impede or interfere with vehicular or pedestrian traffic by engaging in any behavior, display, promotion, event, advertisement, sale, conduct or activity on any public sidewalk, alley, easement, right-of-way, roadway, drive way, curbs, or private property immediately adjacent to above public property. Such interference constitutes a nuisance to traffic and is prohibited by this subchapter.
   (B)   Examples of such prohibited conduct include, but are not limited to:
      (1)   Causing or allowing any projectiles, objects, materials, substances, debris, persons, animals or vehicles to enter a lane of traffic from a sidewalk, alley, curb, easement, driveway, parking lot, right-of-way or private property immediately adjacent to public property.
      (2)   Within 300 feet of any lane of traffic or intersection a nuisance is created by any excessive noise, bullhorns, sports horns, fixed or moving beacon lights, spot lights, search lights, flashing carnival lights, portable lights on trailers, discharge of water, garbage or the emission of smoke, steam, dry ice, or any substance whose release would prevent a motorist from being able to hear emergency sirens, other vehicle horns, shouts from pedestrians, or could obstruct vision or distract a driver traveling on the road in a lane of traffic.
      (3)   Reduction of available customer or staff parking by fixed structures, movable structures, displays, tents, trailers, promotions, or additional vehicles which causes customer traffic to back up into or obstruct vehicular traffic on any street or lane of traffic.
      (4)   Persons wishing to conduct activity listed supra, must petition to the Board of Public Works and Safety prior to the event, and must outline in detail the date, location, times, nature and scope of the activity planned, the level of liability insurance possessed, and what specific traffic control, health, visibility, sound and safety precautions will be implemented to insure the safety and well being of the citizens of Hammond.
      (5)   Each day a nuisance is in existence is a separate offense, and the city is authorized to issue citations or request any lawful court action to abate the nuisance created.
