(A) Citations may be issued for any adopted ordinance violations such as but not limited to, entering an intersection on red, violation of posted no turn on red, or any other violation of posted traffic control devices, established by ordinance in effect or adopted following this program’s adoption.
(B) When the Traffic Law Enforcement System records a motor vehicle violating a traffic control signal, the city shall issue a written notice of the violation to the registered owner or lessee of the vehicle no more than 90 days following the citation.
(C) Each notice of violation associated with an automated traffic law violation shall require the review of the companion recorded image by a representative of the police department for confirmation of violation and elimination of statutory defenses.
(D) Upon confirmation that the recorded image captures a violation, and no defense applies, the citation will be mailed to the registered owner. The city shall keep a copy.
(E) The citation will indicate the name of the owner/lessee, the registration number of the vehicle, the ordinance violated, the location of the violation, the date and time of the violation, the penalty for the violation, and notice that failure to pay or contest liability within 30 days can result in additional penalties, up to and including license suspension. Failure to respond will be deemed a contest of liability and the matter will be sent to court.
(F) Contesting the violation. The citation will indicate that the recipient may elect to pay the fine or challenge the violation which will require an appearance in the City Court. At the court hearing the recorded image, or a copy, may be produced to confirm a violation occurred. Failure to appear at the court hearing can result in a default, additional fines and penalties including court costs, amendment to proving violation or license suspension. The Court may adjudicate violations in accordance with the law.
(G) The city may contract with outside parties to implement and operate the Automated Traffic Law Enforcement System, any may permit administrative adjudication through that party.
