§ 37.029 HEALTH INSURANCE BENEFITS.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      ACTIVE EMPLOYEE/FULL TIME EMPLOYEE. A person who works full-time, at least 35 hours per week, for any department or branch of the city, including elected officials, judges, magistrates, referees, Corporation Counsel, Pauper Counsel, police and firefighters. Employees who are members of Teamsters Local 142, and participate in Central States, are not included under this section.
      HEALTH BENEFITS. Those benefits that are generally provided to active employees such as medical, hospitalization, dental, and vision coverage. These benefits become supplemental and secondary to Medicare when the active employee or retiree, and/or their spouse, become eligible for Medicare benefits.
      RETIREE. An active employee who has applied and is eligible for Public Employees Retirement Fund (PERF) benefits. State law governs eligibility for PERF retirement benefits.
   (B)   Benefits for active employees. Effective January 1, 2013, the city shall adopt and implement an employee health benefit plan benchmarking the State of Indiana Healthcare plans CDHP1, CDHP2. and PPO. Active employees participating in specified plans under this program will receive from the city a Health Savings Account. No employee shall receive any benefit greater than or premium less than those set city ordinance, unless preempted by federal law.
   (C)   Benefits for retirees.
      (1)   Employees.
         (a)   Employees hired after January 1, 2005, must earn at least 15 years of continuous service and be eligible for retirement under the Public Employees Retirement Fund Plan to be eligible for health insurance benefits during retirement.
         (b)   Employees hired prior to January 1,2005, are required to have worked at least 15 years of continuous full time service and to have participated in the State of Indiana plan at the contribution rate listed under this plan.
      (2)   Elected officials. All elected officials who have served 10 years or more shall be entitled to the benefits described in division (B) above.
   (D)   Claims. All claims filed to the City Health Benefit Plan shall be processed and payment made within a period of not more than 90 days after submission. All records of the claims shall be confidential and not part of the public record. All employees who have a change in their status, such as marriage/divorce or child emancipation, must inform the city of such change in status within 30 days of the change in status. Failure to inform the city of such changes may result in denial of benefits for claims related to the change in status.
   (E)   Other employment. All retired members and their dependents, who are employed, are required to participate in the current employer's health plan, if eligible. The City Health Benefit Plan shall be secondary to the current employer’s plan.
