§ 132.035 USE OF COMPOUNDS CONTAINING TOXIC SUBSTANCES.
   (A)   (1)   No person shall inhale, breathe, huff, smoke, ingest or drink any compound, liquid or chemical containing toluol, hexane, trichlorosthylene, acetone, toluene, ethyl acetate, methyl ethyl ketone, trichlorosthane, isopropanol, methyl isobutyl ketone, methyl cellosolve acetate, cyclohexanone, other aerosols, or any form of synthetic cannabinoids, marketed under any name, including but not limited to spice, K2, XXX, Mr. Smiley, or any other substance for the purpose of inducing symptoms of intoxication, elation, dizziness, paralysis, irrational behavior, or to in any manner change, distort or disturb the audio, visual, cognitive or mental processes.
      (2)   For the purpose of this section, any condition so induced by the above substances shall be deemed to be a condition of intoxication, including for driving purposes or other criminal conduct.
      (3)   For the purpose of this section, no form of synthetic cannabinoids, under any form, name, branding or packaging, whether labeled as incense or for ingestion, may be sold in the city. Retailers selling synthetic cannabinoids are subject to license revocation pursuant to § 119.11 of the Hammond Municipal Code.
   (B)   The provisions of division (A) above shall not apply to the following.
      (1)   Any person who inhales, breathes or drinks any material or substance pursuant to the direction or prescription of any doctor, physician, surgeon, dentist or podiatrist authorized to so direct or prescribe the substance.
      (2)   Any person who inhales, breathes, drinks or otherwise in any manner uses any narcotic, dangerous drug or other material or substance or combination thereof, which is defined and the use of which is prohibited or regulated by any law of the state.
