185.02 EXCEPTIONS.

   The City shall not indemnify a public official or employee of the City under any of the following circumstances:

   (a)   To the extent that the public official or employee is covered by a policy of insurance for civil liability purchased by the City;

   (b)    When the public official or employee acts manifestly outside the scope of his or her employment or official responsibilities, with malicious purpose, in bad faith, or in wanton or reckless manner;

   (c)    For any portion of a judgment that represents punitive or exemplary damages. (Ord. 83-1-5. Passed 1-26-83.)
