350.15 COMMERCIAL QUADRICYCLE LICENSE; APPLICATION; FEES.
(a) No person shall operate or permit to be operated any commercial quadricycle, or shall proffer the services of such commercial quadricycle by solicitation by voice, sign, public advertisement, light, or otherwise without a valid commercial quadricycle license issued pursuant to this Chapter.
(b) Each application for a commercial quadricycle license shall contain the name and address of the applicant; the name and address of the commercial quadricycle's owner if different than the applicant; the trade name under which the business is to be conducted; the hours and days of operation; the proposed area to be served; the seating capacity of the commercial quadricycle, the condition of the commercial quadricycle, including age, condition and intended use; the procedures to train operators; whether the commercial quadricycle will be operated by someone other than the applicant; and any other information required by the Director of Finance. The proposed operating zones or permitted routes, hours, and days of operation for each commercial quadricycle shall be reviewed for public safety purposes by the Police Department and Engineering Department. The owner of a commercial quadricycle shall also comply with all requirements of the City of Hamilton and the State of Ohio traffic laws.
(c) Every license shall expire on December 31st of each year unless sooner suspended or revoked by the Director of Finance. License fees for each commercial quadricycle shall be payable to the City of Hamilton in the following amounts:
(1) One hundred and fifty dollars ($150.00); after June 30th of each year, the amount shall be seventy-five dollars ($75.00).
(d) No transfer of a license shall be permitted except with the consent of the Director of Finance, which consent shall be endorsed on the original license. The Director of Finance shall permit a transfer only when it appears that one (1) of the commercial quadricycle owned and operated by the licensee is retired, destroyed, demolished or otherwise rendered unfit for service.
(e) Upon a finding by the City of Hamilton Director of Finance that an extraordinary demand upon any special occasion requires the use of more commercial quadricycle by any person, firm or corporation to whom there has been issued one (1) or more commercial quadricycle license for the calendar year, the Director of Finance may issue special permits, valid for a period not to exceed twenty-four (24) hours, upon the payment of a fee of one dollar ($1.00) each for the use of additional commercial quadricycles which are duly licensed for the transportation of persons for hire and which carry public liability insurance satisfactory to the Director of Law.
