349.99 PENALTIES.
   (a)    Except as otherwise provided in this Chapter, whoever violates Section 349.02 of this Chapter is guilty of a minor misdemeanor. If within one year of the offense, the offender previously has been convicted of or pleaded guilty to a violation of this Chapter, whoever violates Section 349.02 is guilty of a misdemeanor of the fourth degree.
   (b)    Any person who violates any provision of this chapter for which a penalty is not already provided in another section of this Chapter is guilty of a minor misdemeanor and shall be fined up to one hundred and fifty dollars ($150.00). In addition to any other method of enforcement provided for in this Chapter, any violation of the provisions of this chapter which is a minor misdemeanor may be enforced by the issuance of a citation in compliance with Rule 4.1 of the Ohio Rules of Criminal Procedure.
