171.061 WAIVING OF ADVERTISEMENT FOR BIDS FOR THE PURCHASE OF COAL, NATURAL GAS AND ELECTRICITY.
   In any purchase of coal, natural gas and electricity, as well as the purchase of transportation and transmission therefor, involving an expenditure of seventy five thousand dollars ($75,000) through calendar year 2024 with an increase of three percent (3%) for each calendar year thereafter, as determined and published by the Ohio Director of Commerce or more, the requirement for the advertisement for bids which would otherwise be required by this chapter shall be waived subject to the following conditions:
   (a)    The terms and conditions of the contract of the open market purchase shall be approved by the City Manager.
   (b)    The price terms of the contract of the open market purchase shall be within the bounds of the applicable appropriation ordinance so that sufficient funds have been encumbered for such purchase.
   (c)    Insofar as practicable, subject to the reasonable discretion of the City Manager, the term of any one such contract of open market purchase shall be limited to one year.
   (d)    Insofar as practicable, subject to the reasonable discretion of the City Manager, the City Manager may direct the Purchasing Agent to secure bids or quotations, either formally or on an informal quotation basis, to document the financial or other advantage or necessity of the City's entering into such open market contract of purchase with the seller.
   (e)    Council shall receive a report from the City Manager documenting the basis for such open market contract or purchase.
