1781.02 TOBACCO USE PROHIBITIONS.
      (a)    In order to properly promote the health, safety and wellness of City employees, to eliminate the well-known risks attendant to second-hand smoke in the best interest of public health, as well as to enhance the quality of life of all those whom the City serves including residents and visitors to public City facilities or related areas; and to aid in the enforcement of the provisions of Ohio Revised Code Chapter 3794, the City of Hamilton hereby designates any public place, as defined herein, to be tobacco-free, whereby any use of tobacco is prohibited, except areas specifically designated by the Director of Health or his/her designee as a tobacco use area.
   (b)    The Director of Health or his/her designee may designate additional public places or special events tobacco-free for a limited period of time not to exceed seven (7) days on a case-by-case basis.
   (c)    No person shall refuse to immediately discontinue tobacco use in any public place declared tobacco-free by this section when requested to do so by the Director of Health or his or her designee.
   (d)    Lack of intent to violate a provision of this chapter shall not be a defense to a violation. (Ord. 2022-4-26. Passed 4-13-22.)
