1781.01 DEFINITIONS.
(a) "Employee" means a person who is employed by the City of Hamilton.
(b) "Public place" means and refers to the following spaces and related areas which are owned or under the control of the City of Hamilton and open to the public without regard to whether or not a fee or admission is charged:
(1) All public parks and natural areas;
(2) All City places of employment and other City facilities;
(3) All exterior areas of City places of employment and other City facilities; and
(4) All municipally-owned parking lots and garages.
"Public place" includes streets, sidewalks, paths, and alleyways located within the locations listed above, but does not include streets, sidewalks, paths and alleyways outside of locations listed above.
(c) "City place of employment" means an enclosed or open area under the direct or indirect control of the City of Hamilton that the City's employees use for work, or any other purpose, including but not limited to, offices, meeting rooms, operations and storage areas, restrooms, stairways, hallways, warehouses, garages, and vehicles. The areas as described above are places of employment without regard to the time of day or the presence of employees.
(d) "Use of tobacco" means all uses of tobacco, including inhaling, exhaling, burning, vaping, or carrying any lighted cigar, cigarette, pipe, alternative nicotine product, other lighted smoking device or papers for burning tobacco, or any other plant; chewing tobacco snuff, or any other matter or substances that contain tobacco.
(e) "Alternative nicotine product" means an electronic cigarette or any other product or device that consists of or contains nicotine that can be ingested into the body by any other means, including, but not limited to, chewing, smoking, absorbing, dissolving, or inhaling. Nicotine gum, nicotine patches, or any other nicotine replacement therapy aids are excluded.
