1751.02 PERMIT.
(a) No person shall operate a temporary mass gathering unless a permit has been issued for that gathering by the Health Department.
(b) Application for a permit to operate a temporary mass gathering shall be made to the Commissioner of Health by the person who will operate the temporary mass gathering on a form and in a manner prescribed by the Commissioner of Health.
(1) Application for a permit to operate a temporary mass gathering shall be made at least fifteen (15) days before the first day of advertising and at least forty-five (45) days before the first day of the gathering.
(2) The application shall be accompanied by such plans, reports, and specifications as the Commissioner of Health deems necessary.
(c) A separate permit shall be required for each temporary mass gathering.
(d) The permit to operate a temporary mass gathering shall be revoked by the Health Department if the temporary mass gathering is promoted, operated, maintained, or conducted in violation of any provision of this chapter.
(e) The permit shall automatically expire:
(1) Upon written request of the permittee; or
(2) Upon abandonment of the promotion of the temporary mass gathering; or
(3) Upon conclusion of the time period for which the permit was issued.
(f) A permit issued for the operation of a temporary mass gathering shall be posted or kept on file by the permittee and must be made available to the proper officials upon their request.
(g) The fee for a temporary mass gathering permit shall be one thousand dollars ($1,000).
(h) In the event of cancellation of the permit prior to the time period for the temporary mass gathering for which the permit was issued, all expenses incurred by the Health Department shall be deducted from the permit fee. The balance, if any, shall be returned to the applicant.
(i) Permits are not transferable.
