1751.01 DEFINITIONS.
   As used in this chapter, the following terms have the following meanings:
      (a)    "Commissioner of Health" means the health authority of the City of Hamilton, and his or her authorized representative or designee.
      (b)    "Health Department" means the Hamilton Department of Health.
      (c)    "Temporary Mass Gathering" means an assembly at one time of two thousand, five hundred (2,500) or more people for a limited time:
      (1)   Which is:
         A.    Not sponsored by the State; or
         B.    Not sponsored by any of the State's political subdivisions; or
         C.    Not sponsored by any agency of either the State or the State's political subdivisions;
      (2)    That is not in a place designed and constructed for such type of assembly
      (3)    And is not either:
         A.    A camp; nor
         B.    A trailer park; nor
         C.    A trailer park or travel trailer overnight port as defined in the Ohio Sanitary Code; nor
         D.    A motel or hotel as defined in Ohio R. C. 3731.01.
      (4)    The Health Department shall have the authority to determine that the numbers anticipated for the gathering are accurate.
   (d)    "Permittee" means the person who applies for and receives a permit from the Health Department allowing for a temporary mass gathering.
      (e)    "Person" means an individual, partnership, association, syndicate, company, firm, trust, corporation, or any other legal entity.
