1195.01 FLOOD PRONE LAND.
In order to protect the safety, health, and general welfare of the people of Hamilton, subdivisions shall minimize any impact of developmenton flood prone lands, both within the subject subdivision and on adjacent properties. When a subdivisionis located in an area having poor drainage or other adverse physical conditions, the Planning Commission may approve the plat of the proposed subdivision; provided the Subdivider agrees to perform such improvements as will, in the judgment of the Planning Commission, render the subdivision substantially safe and otherwise acceptable for use, and furnishes the Planning Commission with a performance bond or cash deposit to the City, running to the City of Hamilton, sufficient to cover the cost of such improvements as estimated the Director of Engineering and the officials have jurisdiction.
In laying out a subdivision, the Subdivider shall comply with the following general principles and requirements that follow in this Chapter.
