171.064 WAIVING OF ADVERTISEMENT FOR BIDS FOR PURCHASE OF COMMUNICATIONS AND FIBER OPTIC RELATED PRODUCTS AND SERVICES.
   For any purchase of communications and fiber optic related products, as well as the purchase of communications and fiber optic related services therefor, involving an expenditure of fifty thousand dollars ($50,000) or more, the requirement for the advertisement for bids which would otherwise be required by this chapter may be waived subject to the following conditions:
   (a)   The terms and conditions of the contract of the open market purchase shall be approved by the City Manager.
   (b)   The price terms of the contract of the open market purchase shall be within the bounds of the applicable appropriation ordinance so that sufficient funds have been encumbered for such purchase.
   (c)   Insofar as practicable, subject to the reasonable discretion of the City Manager, the term of any one such contract of open market purchase shall be limited to one year. Further subject to the discretion of the City Manager, these open market purchases may be renewed on an annual basis, for up to nine renewal periods.
   (d)   Insofar as practicable, subject to the reasonable discretion of the City Manager, the City Manager may direct the Purchasing Agent to secure bids or quotations, either formally or on an informal basis, to document the financial or other advantage or necessity of the City's entering into such open market contract of purchase with the seller.
   (e)   Council shall receive a report from the City Manager documenting the basis for such open market contract or purchase.
