315.01 DEFINITIONS.
   As used in this Chapter the following definitions shall apply:
   (a)    "Block Party" means a gathering of a group of neighbors who gather together to enjoy themselves within their own neighborhood by closing a public street.
   (b)    "Director of Safety" means the Director of Public Safety of the City.
   (c)    "Chief of Police" means the Chief of Police of the City and/or his or her designee.
   (d)    "City Manager” means the City Manager and/or his or her designee.
   (e)    "City" means the City of Hamilton.
   (f)    "Demonstration" means a gathering of ten or more persons in the streets, parks, or other public facility or place owned or under the control of the City, the purpose of which is to present a public display of group feelings toward a person or cause, or for the purpose of expressive activity.
   (g)    "Event" means any parade, demonstration, block party, rally or recreational assembly.
   (h)    "Parade" means any procession or motorcade consisting of persons, animals, or vehicles or a combination thereof upon the streets, parks or other public facility or place owned or under the control of the City.
   (i)    "Person" means any person, firm, partnership, association, corporation, company or organization of any kind.
   (j)   "Recreational Assembly" means any meeting or assembly, for the purpose of a festival, pageant, exhibit, show or any other similar display with the gathering of more than ten (10) persons for a common purpose that is in a public facility or place owned or under the control of the City.
   (k)    "Rally" means a gathering of ten (10) or more persons in a procession in the streets, parks, or other public facility or place owned or under the control of the City, with the purpose to present a public display or to commemorate or recognize a particular event or time in history, view point or culture, also, may be for the purpose of expressive activity; however this does not include funeral processions.

   (l)    "Professional Film Project" means the creation of motion picture images and all activity attendant to staging, shooting, and associated base camp operations associated with the production of commercial motion pictures, independent filmography, documentaries, music videos, television shows, and commercials. Filming also means creating still photography images for commercial use and all activity attendant to staging or shooting such images. A professional film project does not include filming by news organizations and individual citizens unless special assistance is needed from the City.
   (m)    "Special Event" means a temporary gathering of people, using either private or public property, in which the estimated number of participants exceeds seventy- five (75) during any day of the event, unless for a professional film project in which the number or participants may be less than seventy-five, and which involves one or more of the following activities, except when the activity is for construction or house-moving purposes only:
      (1)   Closing a public street;
      (2)    Blocking or restriction of public property;
      (3)    Sale of merchandise, food or beverages on public property or on private property where otherwise prohibited by law;
      (4)    Erection of a tent on public property, or on private property where otherwise prohibited by law;
      (5)    Installation of a stage, bandshell, trailer, van, portable building, grandstand or bleachers on public property, or on private property where otherwise prohibited by law;
      (6)    Placement of portable toilets on public property, or on private property where otherwise prohibited by law;
      (7)    Placement of temporary "No Parking" signs in a public right-of-way.
      (8)    A professional film project when the project is in the public right-of-ways, on or within any City-owned property.
   (n)    "Recurring Special Event" shall mean a special event that takes place during more than one nonconsecutive calendar days but that is hosted by the same sponsors, at the same location, for the same purpose, with the same event name, for the same or similar hours of operation or activity. A recurring special event takes place for multiple, separate periods of time throughout a portion of the calendar year but remains substantially the same event.
   (o)    "Special event permit" means a permit required by this chapter.
