303.09 CHIEF OF POLICE TO SUPERVISE IMPOUNDING VEHICLES.
   (a)   In order to make feasible arrangements for caring for impounded vehicles, the Chief of Police or his designee is hereby directed to examine the facilities and general condition of wrecker service companies who have completed Tow Service Agreements with the City of Hamilton on an annual basis. Those agreements shall include provisions regarding the reimbursement that those companies may receive for towing and storage of vehicles. The Chief of Police shall report to the City Manager, tow service operators which have requested to be added to the list of wrecker operators who provide towing services to the City of Hamilton. The tow service companies shall complete Towing Service Agreements with the City of Hamilton, which shall be maintained on file with the City Manager which shall list the names and locations of the tow service operators as well as charges that are permitted for related services. Whenever the City provides a municipally owned vehicle impoundment facility, vehicles impounded pursuant to this Traffic Code shall be impounded therein, provided that in the event the capacity of such public impoundment facility is about to become or has become over-taxed, then the City Manager, upon recommendation of the Chief of Police, shall make arrangements with tow service operators in the manner set forth above for the impounding of vehicles which cannot be impounded in the municipally owned vehicle impoundment facility.
 
   (b)   The owner of any vehicle which remains in the impoundment facility longer than six hours shall pay the storage charges thus incurred after the six-hour period which shall be computed at the rate reported to Council by the City Manager, or if such vehicle has been impounded in a wrecker service impoundment facility such owner shall pay storage charges as set by the City Manager, upon recommendation of the Chief of Police.
