973.07 CONTAINERS FOR SOLID WASTE AND RECYCLABLE MATERIAL COLLECTION.
Each householder, commercial operator, establishment, or real property owner within the City where solid waste is accumulated will be provided one 96 gallon cart for the exclusive use on such premises or the part thereof occupied by the householder, owner or commercial establishment for solid waste accumulated during the period between collections. All such solid waste shall be placed in the cart provided and the lids firmly fixed thereto promptly upon removing the material from indoors to outdoors.
(a) All nondisposable carts utilized for the purpose of solid waste collection shall be issued by the collection contractor and have a capacity no greater than ninety-six gallons. The carts shall be designated for the City of Hamilton and of sufficient strength, plastic or metal construction, with a tight-fitting lid to provide for the efficient and intact transfer of its contents to collection vehicles without incidence of water infiltration or leakage. Such carts shall be equipped with suitable handles for carrying and dumping purposes. No containers shall be utilized other than those provided for solid waste by the City or its collection contractor. Containers which pose a threat to the safety of the collection contractor shall be marked by the collection contractor with a tag identifying them as a need of replacement. Continued use of containers or carts not provided for in this chapter shall result in their collection by the contractor for disposal.
(b) Yard waste may be disposed by using resident-owned 35-gallon containers, brown paper bags or plastic bags, with a maximum weight limit of 50 pounds. Limbs and brush must be bundled in 4-foot lengths.
(c) Disposable containers are prohibited.
