973.01 DEFINITIONS.
   For purposes of this chapter the following terms shall have the following meanings:
   (a)   "Collection contractor" means the person awarded a contract by the City to safely collect and properly dispose of solid waste as herein defined from all households and commercial operators within the limits of the City;
   (b)   "Commercial operator" means all persons who own or operate stores, restaurants, industries, institutions and other similar places, whether public or private, whether charitable or noncharitable and includes all responsible persons other than householders on the premises at which solid waste is created or accumulated.
   (c)   "Commercial solid waste collector" means all persons collecting, transporting or disposing of the solid waste of others within the corporate limits of the City.
   (d)   "Dead animals" means dogs, cats, rabbits, squirrels, rats and similar sized animals that die regardless of the cause of death. "Dead animals" shall not include horses, cows, goats, sheep, hogs and similar sized animals, or any other animals that are condemned or from slaughterhouses, rendering plants, veterinarians or other like establishments.
   (e)   "Dwelling unit" means the place of abode of the person or persons living singly or together as an independent family.
   (f)   "Garbage" means the animal and vegetable waste resulting from the handling, preparation, cooking and serving of food for human consumption from home kitchens, stores, markets, restaurants, hotels, institutions and other places where food is stored, prepared or served. "Garbage" does not include food processing wastes from canneries, slaughterhouses, packing plants or similar industries nor large quantities of condemned food products.

   (g)   "Householder" means the head of a family or one maintaining separate living quarters and shall include owners, tenants and occupants of all premises, whether the premises are vacant or occupied. Nothing in this definition shall be construed to apply to commercial operators as hereinafter defined.

   (h)   "Person" means every individual, corporation, business, estate trust, partnership and association.
   (i)   "Open burning" means the burning of solid waste in an open area or burning solid waste in a type of chamber or vessel that is not approved in rules adopted by the Director of the Ohio EPA under Ohio R.C. 3734.02.
   (j)   "Open dumping" means the deposition of solid wastes into waters of State, and also means the final deposition of solid wastes on or into the ground at any place other than a solid waste facility operated in accordance with Ohio R.C. Chapter 3734 and Chapter 3745-27 and 3745-37 of the Administrative Code.

   (k)   "Premises" means land or buildings, or both, or parts of either or both, occupied by a householder, whether the premises are vacant or occupied, or commercial operator.

   (l)   "Recycling" means the process of collecting, sorting, cleansing, treating and reclaiming and reconstituting solid waste that would otherwise be disposed in a solid waste disposal facility and returning reconstituted materials to commerce as commodities for use or exchange.

   (m)   "Recycling bin or cart” means a storage unit provided by the City or its contractor in which recyclable material is to be placed and commingled by the occupants of each dwelling unit unless served by other storage units.

   (n)   "Recycling contractor" means the contractor authorized by the City to collect and then arrange for the reclamation of recyclable materials.
   (o)   "Recyclable material" means ferrous and nonferrous cans, newspaper, glass bottles, plastic bottles and products or other products as deemed recyclable by the Director of Public Works.
   (p)   "Scavenging" means the removal of material by a person other than the owner of such materials from the solid waste stream at a solid waste disposal facility, solid waste transfer facility or from the recycling bins that have been properly set out at the street or alley for collection by the City or its designated recycling contractor.
   (q)   "Solid waste" means such unwanted residual solid or semisolid materials resulting from industrial, commercial, agricultural and community operations. "Solid waste" does not include earth or material from construction, mining or demolition operations, or other waste materials of the type that would normally be included in demolition debris, nontoxic fly ash, spent nontoxic foundry sand and slag and other substances that are not harmful or inimicable to public health, and includes, but is not limited to garbage, tires, combustible and noncombustible material, street dirt and debris. For the purpose of this definition, material from construction or demolition operations are those items affixed to the structure being constructed or demolished, such as brick, concrete, stone, glass, wall board, framing and finishing lumber, roofing materials, plumbing, plumbing fixtures, wiring and insulation, but excludes material which is required to be removed prior to demolition. Solid waste does not include any materials that is an infectious waste, hazardous waste, asbestos waste or recyclable materials as defined in this section. For the purpose of this definition, semisolid material does not contain liquids which can be readily released under normal climatic conditions.    (r)   "Yard waste" means solid waste that includes only leaves, grass clippings, brush, garden waste, tree trunks, holiday trees, tree trimmings and/or prunings.
