935.10 SANITARY SEWER MAIN IMPACT CONNECTION FEE, COST PARTICIPATION, AND SYSTEM CAPACITY CHARGE.
   (a)   The sanitary sewer main impact connection fee shall be determined as follows:
      (1)   Within the City: For each sanitary sewer main connection within the City a uniform fee of two thousand five hundred dollars ($2,500) per sanitary sewer connection shall be paid to the City, with one thousand eight hundred seventy- five dollars ($1,875) of that total due at the time the record plat is submitted, and the remaining six hundred twenty-five dollars ($625.00) due when the building permit is collected.
      (2)   Outside the City: For each sanitary sewer main connection outside the City a uniform fee of three thousand seven hundred fifty dollars ($3,750) per sanitary sewer connection shall be paid to the City, with two thousand eight hundred thirteen dollars ($2,813) of that total due at the time the record plat is submitted, and the remaining nine hundred thirty-seven dollars ($937.00) due when the building permit is collected.
   (b)   The cost participation and system capacity charge shall be determined as follows:
      (1)    Within the City.
         A.    The City will pay the difference in cost between a line of a size and depth necessary to serve a development under single ownership and/or control and a line of a size and depth required by City overall sewer system planning.
         B.    The determination as to whether or not to participate in paying a part of the cost of sanitary sewer mains shall be based on the relationship of cost to the benefit to be gained in the form of providing for orderly and reasonable growth of the City. The determination as to when to participate shall be based on the comparative benefit to the City of lines which are the subject of requests for City participation.
         C.    To obtain a portion of the necessary funds for the City cost participation in additional sewer collection system facilities, a system capacity charge shall be levied as follows:
            1.   New connections made to the City's sanitary sewer system shall be subject to a system capacity charge based on the size of water meter installed in accordance with the table set forth in subsection (b)(1)C.2. hereof.
            2.   Existing structures previously served by the City's sanitary sewer system where the usage and the capacity has increased to the extent that a larger water meter is required shall be subject to a system capacity charge based upon the difference between the new meter size and the old meter size in accordance with the following table:

            For a multi-family residential structure wherein each dwelling unit has a separate individual meter, the system capacity charge shall be calculated on the basis of an equivalent size single meter of adequate capacity to supply the water usage demand for the structure. The water demand and equivalent meter size to satisfy said demand shall be calculated by an engineering analysis of the size and type of the multi-family structure in accordance with regulations promulgated by the Director of Public Utilities.
            The above charges shall be paid at the time application is made for a building permit in the case of a new structure, or a plumbing permit in the case of an existing structure.
         D.   All moneys collected hereunder shall be deposited in a special fund for the aforesaid purposes.
         E.   The system capacity charge set forth in subsection (b)(1)C. hereof shall not be assessed when all of the following conditions apply:
            1.   The sanitary sewers to be installed benefit a sanitary sewer service area which has previously been developed without being served by City sewers and has been in existence for at least five years;
            2.   The sanitary sewer to be installed abates a known public nuisance in the service area;
            3.   All the affected owners in the area benefitted by the sanitary sewer improvement have contractually obligated themselves to tap the new sewer upon its completion, or when such affected owners are directed by the Director of Public Works to tap the new sewer; and
            4.   All necessary sanitary sewer easements across the property of the owners to be served by the sewer improvement are granted to the City without charge.
      (2)   Outside the City.
         A.   Residential properties. Effective July 1, 2006, the system capacity charges for residential properties being served by the City’s sanitary sewer system and located outside the corporate limits of the City, shall be determined by using an Equivalent Residential Unit (see note below) method and shall be as follows:

         B.   Commercial properties. Effective July 1, 2006, the system capacity charges for commercial properties being served by the City’s sanitary sewer system and located outside the corporate limits of the City shall be determined by the size of the water meter serving such properties and shall be as follows:

         D.   All moneys collected hereunder shall be deposited in a special fund for the aforesaid purposes.
         E.   Butler County, Ohio shall pay to the City one-half of all applicable system capacity charges upon approval of the permit to install the sanitary sewer collection system by the Ohio Environmental Protection Agency. The remaining one-half of such charges shall be payable by Butler County when building permits are issued by Butler County.
      (3)   The sewer system capacity charge for sewer service provided to customers located within the Kiesland Business Park Sewer District shall be equal to the charge established for that charge in the Sewer Service Agreement dated July 29, 1988 among the City of Hamilton, the City of Fairfield, and Butler County, Ohio, and as that agreement is amended from time to time.
