907.03 DEPOSIT FOR RESTORATION; NONLIABILITY OF CITY.
   The Director of Public Works shall not issue any permit to cut or excavate any street, thoroughfare, park or other public ground unless for some lawful purpose, and unless such cut or excavation is reasonably necessary. He may, in granting any permit, modify any particulars of the application therefor, and impose conditions therein, for the purpose of minimizing any inconvenience or injury to the public and the public property thereby. He shall not issue such permit until the applicant has deposited with the Director of Finance a sum of money sufficient to defray the cost of refilling such excavation, removing any excess materials, and restoring the pavement or other surface as may be required by ordinance and to the satisfaction of the Director of Public Works, nor until the applicant shall have given security satisfactory to the Director of Law that he will save the City harmless from all claims for damage by reason of any excavation or other work done under such permit.
   The deposit to be made under this section shall be at the rate of fifteen dollars ($15.00) per square yard or remaining fraction thereof in the case of improved streets, and at the rate of five dollars ($5.00) per square yard in the case of unimproved streets or in other places.
