761.50 PERIODIC SAFETY AND EQUIPMENT INSPECTIONS.
   (a)   Upon the direction of the Transportation and Traffic Engineer or his designate, which direction shall occur not less than twice a year and may be given without warning, a taxicab owner/operator shall immediately present one or all of his/her/its taxicabs, as the Transportation and Traffic Engineer or his designate shall require, to the Ohio State Highway Patrol Post on Hamilton-Middletown Road or such other law enforcement agency as the Transportation and Traffic Engineer or his designate may direct for a safety and equipment inspection in accordance with the standards applied by the Ohio State Highway Patrol.
   (b)   Any taxicab which fails inspection shall immediately be removed from service and its license shall be suspended. Such taxicab shall not be returned to service nor have its license restored until such time as:
      (1)   All conditions which caused the taxicab to fail the inspection have been corrected and have been reinspected,
      (2)   The inspecting agency finds the taxicab passes the same inspection that it originally failed and provides written verification or a sticker or that effect, and
      (3)   The taxicab is deemed by the Transportation and Traffic Engineer to be in full compliance with all applicable rules and regulations contained in this chapter.
   (c)   If within twenty-four hours of being directed by the Transportation and Traffic Engineer or his designate to the Ohio State Highway Patrol or other law enforcement agency for an inspection the taxicab owner/operator does not present proof that it passed the safety and equipment inspection, or show good cause because of difficulties originating with the law enforcement agency why the taxicab could not be inspected within twenty-four hours, the uninspected taxicab's license shall immediately be suspended and not be restored unless and until such time as the taxicab passes the safety and equipment inspection.
