761.40 REQUIREMENTS FOR TAXICAB DRIVER'S LICENSE.
   (a)   An applicant for the initial issuance or subsequent renewal of a taxicab driver's license shall meet the following requirements:
      (1)   Be twenty or more years of age;
      (2)   Be in sound physical condition, have good eyesight and not subject to any infirmity, defect or disorder of mind or body which might reasonably render him/her unfit for the safe carrying out of the duties of driving a taxicab, as determined from all reliable medical, psychological or health information supplied by the driver or other persons concerning the driver's physical or mental condition and a drug test as set forth in Section 761.41. The qualifications in this subsection shall be supported by an affidavit of the applicant.
      (3)   Possess a working knowledge of the traffic laws of the City of Hamilton and the state of Ohio; and
      (4)   Possess a valid operator's license issued by the State.
   (b)   A taxicab driver's license may not be issued to any person who:
      (1)   Has been convicted of, pled guilty or no contest to, any offense constituting a felony within the previous five years;
      (2)   Has been adjudged mentally incompetent and has not been legally restored to competency;
      (3)   Is awaiting court action for any criminal offense;
      (4)   Is subject to any infirmity, defect or disorder of mind or body which might reasonably render him/her unfit for the safe carrying out of the duties of a taxicab driver, or a taxicab operator as determined from all reliable medical, psychological or health information supplied by the applicant or other persons concerning the applicant's physical or mental condition;
      (5)   Within two years prior to filing the application for a license has been convicted of, pled guilty to or forfeited bond for four or more moving traffic offenses, whether charged under State law or ordinances of any jurisdiction;
      (6)   Has complied an unsafe driving record based on a consideration of the applicant's driving prior to the previous three years; or a persistent record of arrests or convictions that exhibit a disregard for the law;
      (7)   Has had his or her driver's license suspended by a court within three years preceding the application;
      (8)   Has had his or her driver's license suspended by administrative action within three years preceding the application;
      (9)   Has been convicted within three years preceding the application of either driving or being in physical control of a motor vehicle while under the influence of alcohol and/or drugs, driving while under suspension or reckless operation, drag racing, leaving the scene of an accident or substantially similar offenses as defined and prohibited by the laws of Ohio, any other state or any municipality irrespective of the state in which it is located; or
      (10)   When tested for the use of drugs of abuse, tests positively for such use and cannot provide a medical justification or another good and legal reason for such positive test result.
