761.21 COLOR SCHEME AND INSIGNIA REQUIRED.
   (a)   No taxicab company covered by the provisions of this chapter shall be authorized or permitted to use a color scheme, name, monogram or insignia that in the opinion of the City Manager imitates a color scheme, monogram, name or insignia used by any other taxicab company, or act in such fashion as to mislead or tend to deceive the public. In case of dispute as to the right to use any name, insignia, monogram, color scheme or style of painting or lettering, it shall be resolved in favor of the person having the earlier priority of use, unless he has abandoned such use for one year or more.
   (b)   After a certificate of public convenience and necessity has been issued to a taxicab company, the color scheme, monogram or insignia of the company's taxicab shall not be changed without the prior written approval of the City Manager, or his designate and amendment of its certification of public convenience and necessity.
   (c)   The full name, monogram or insignia of the taxicab company shall be conspicuously displayed on each side and rear of each taxicab, in letters at least three inches high or, in the case of a monogram or insignia, not less than eight inches high.
   (d)   Prior to the issuance of a certificate, the applicant shall present a photograph to the City Manager in the color of the color scheme, name, monogram or insignia it intends to use.
