761.11 SUSPENSION OR REVOCATION.
   (a)   Any certificate of public convenience and necessity may be suspended or revoked at at any time by the City Manager, or his designate, if:
      (1)   The owner fails to operate its taxicab company in accordance with the provisions of this chapter, or other ordinances of this City, or the laws of Ohio; or
      (2)   The owner ceases to operate such taxicabs for a period of thirty consecutive days without first obtaining the consent of the City Manager, or his designate; or
      (3)   The owner fails to keep in force or on deposit with the City the policy of insurance hereinafter described; or
      (4)   The owner fails to report to the Director of Finance any information received from a physician in accordance with Ohio R.C. 2305.33 that a taxicab driver is or may be unfit to operate a taxicab.
   However, no certificate shall be revoked unless due notice of a hearing is given to the holder thereof and such hearing has been duly had thereon.
   (b)   In the event of a violation of any of the provisions of in this chapter which results in an emergency situation in which continued operation by the taxicab company endangers the health, welfare or safety of the public, or manifests a conscious disregard for the provisions of this chapter, the City Manager, or his designate, may suspend any certificate issued hereunder; any such suspension may be made effective immediately and without a hearing pending the conduct of a hearing within fifty-eight hours, but provided that no such hearing shall take place on a Saturday, a Sunday or a legal holiday. In such an event, a hearing shall take place on the next business day immediately following the Saturday, Sunday or legal holiday when such hearing would otherwise have been proper.
