761.08 APPLICATION FOR CERTIFICATE.
   Any person desiring to initially secure or subsequently amend a certificate of public convenience and necessity shall file with the City Manager, or his designate, a written application therefor, on a form to be provided by the City. The application shall be in affidavit form and contain the following information:
   (a)   The full name, age and residence of the applicant, if it is a sole proprietorship. If the applicant is a partnership, the full name, age and residence of each of the partners and a balance sheet for the most recently ended business year. If a corporation, the full name of the corporation and its principal place of business, together with the full name of its principal officers, and a statement of the names and addresses of the shareholders, if there are less than ten, together with the number and par value of shares belonging to each, and a copy of the applicant corporation's certificate of incorporation;
   (b)   The name under which the applicant will do business;
   (c)   The type of vehicles which are to be used in service, with information as to age, mileage, carrying capacity; the color scheme, local symbols to be used together with all other lettering or marks proposed to be used by the applicant on the vehicle;
   (d)   The number of taxicabs proposed to be used and a statement that the applicant is aware of the rate of fare to be charged and the method of charging the same pursuant to this chapter;
   (e)   A certificate of insurance executed by a duly licensed representative of an insurance company licensed and admitted to sell motor vehicle insurance in the State insuring all taxicabs of the owner or operator in conformity with all requirements contained in this chapter;
   (f)   The City Manager, or his designate, may, in the exercise of sound discretion, require such other information as to the applicant's financial or other fitness to safely conduct the operation of a taxicab service in the City, including an inquiry into whether the applicant is otherwise indebted to the City or in default upon an indebtedness to the City; and
   (g)   The application shall be accompanied by a nonrefundable application fee of two hundred and fifty dollars ($250.00) to cover the expense of the City in investigating the applicant, serving notice of public hearing, and considering the granting or denial of the certificate sought by the applicant. Any person possessing a Hamilton taxicab license on or before September 10, 1992 shall be exempt from paying the aforesaid nonrefundable application fee.
