761.04 HOURLY RATES.
Any passenger engaging a taxicab may stipulate the use of an hourly rate, as determined by the operator, during his use of such vehicle, and it shall be unlawful for the operator or driver to refuse to serve at an hourly rate, which shall be the same regardless of the number of passengers carried, unless the passenger expressly ordered and was furnished a vehicle seating more than five passengers, provided that the hourly rate is consistent for like passengers similarly situated.
