513.15 SOLICITING A CONTROLLED SUBSTANCE TRANSACTION.
(a) No person with intent to purchase, obtain or actually or constructively possess a controlled substance, shall induce, solicit, entice or cause another person to provide or attempt to provide a controlled substance in exchange for property, services, money, or any other item, thing or benefit of value.
(b) Any vehicle, motor vehicle, motorcycle, motorized bicycle, truck or bus used for the purpose of soliciting a controlled substance transaction is hereby declared to be a nuisance and contraband, and such vehicle, motor vehicle, motorcycle, motorized bicycle, truck or bus, and the contents thereof, are also hereby declared to be a nuisance and contraband, and such nuisance and contraband shall be enjoined and abated by the institution of forfeiture proceedings pursuant to Ohio R.C. 2933.43.
(c) This section does not apply to any person who purchases or otherwise obtains a controlled substance pursuant to a prescription issued by a practitioner. This section also does not apply to manufacturers, practitioners, pharmacists, owners of pharmacies and other persons whose conduct is in accordance with Ohio R.C. Chapters 3719, 4715, 4729, 4731 and 4741.
(d) Whoever violates any provision of this section shall be guilty of solicitation of a controlled substance, a misdemeanor of the first degree.
