Section 9.05 BOARD OF ADJUSTMENT.
   (1)   The City Council shall create and establish a Board of Adjustment which shall consist of five (5) members and two (2) alternates. The City Council shall, by ordinance, provide standards and procedures for such board to hear and determine appeals of administrative decisions, authorize in specific cases a variance from the terms of the zoning ordinance if the variance is not contrary to the public interest and, due to special conditions, a literal enforcement of the ordinance would result in unnecessary hardship, and so that the spirit of the ordinance is observed and substantial justice is done and such other matters as may be required by the City Council or by law. Appointment and removal of members to the Board of Adjustment shall be in accordance with the laws of the State of Texas.
   (2)   The Board shall meet at the call of the presiding officer and at other times as may be determined by the Board. The Board shall record minutes of its proceedings which minutes shall be maintained as a public record by the City Secretary. The Board shall serve without compensation.
