A. Section 304.1.2 Vegetation, is not adopted, as the City of Gridley Municipal Code Chapter 8.08 titled "Abatement of Weeds and Rubbish" is more restrictive.
B. Section 307 Open Burning and Recreational Fires, is not adopted, as the City of Gridley Municipal Code Chapter 8.12 titled "Burning Restrictions" is more restrictive.
C. Section 505.1 Address Numbers, is amended by the addition of the following: Any business in a commercial occupancy which affords vehicular traffic access to the rear through any driveway, alleyway, or parking lot shall also display the fronting street address on the rear of the building.
D. Section 901.1 Scope, is amended by the addition of the following: When the requirements of CBC Chapter 9 Fire Protection Systems conflict with the requirements of California Fire Code Chapter 9 Fire Protection Systems, the requirements of Chapter 9 of the Fire Code shall govern.
E. Section 3308.1 General, is amended as follows: The retail sales and use of "safe and sane" fireworks as defined by the California Health and Safety Code are permitted within the city limits of Gridley when all the following requirements are met, in addition to the requirements of the Health and Safety Code and the State Fire Marshal's regulations (Title 19 California Code of Regulations, Chapter 6 - Fireworks):
1. A permit to engage in the retail sales of safe and sane fireworks must be obtained from the City Clerk and the California State Fire Marshal.
2. The City Clerk shall only issue a permit to non-profit organizations or corporations organized primarily for veterans, patriotic, civic betterment or charitable purposes.
3. Any organization or corporation to which a permit is issued shall have been established with a bonafide membership for a minimum of one year continuously preceding the filing of the application for a permit.
4. The organization or corporation shall have as its principal and permanent meeting place a physical location within the United States Post Office zip codes areas of 95948 or 95917.
5. No organization or affiliate of said organization shall submit more than one application for a permit to sell fireworks within the City of Gridley. Submittal of more than one application shall be grounds for denial of all applications.
6. Any person, firm, or corporation or organization applying for a retail sales fireworks permit shall furnish the City of Gridley and the Gridley Fire Department satisfactory proof of insurance which shall contain the following provisions:
a. The City of Gridley, its officers, officials, employees and/or volunteers are to be included as additional insureds.
b. The permittee's insurance coverage shall be primary in all instances other than those resulting from the sole negligence on the part of the City of Gridley.
c. Insurance coverage of the permittee shall not be suspended, voided, canceled or reduced in coverage or in limits without thirty (30) days prior written notice being given to the City of Gridley by certified mail with return receipt requested.
d. The minimum scope of insurance shall be at least as broad as commercial General Liability coverage (occurrence Form CG 0001) with limits no less than $1,000,000 per occurrence for bodily injury, personal injury and property damage. Any deductible in excess of $500.00 per occurrence shall be reviewed and approved by the City Council of the City of Gridley.
e. Any insurance carrier utilized to satisfy "d" above shall have a current A.M. best rating or VII or better.
7. Fireworks stands of storage shall not be located closer than fifty (50) feet to the nearest structure nor located in any area zoned as residential as set forth in Title 17 of the Gridley Municipal Code.
8. All required permits and licenses must be posted on an interior wall of the stand in plain view, and the correct location/address for the stand must be shown.
9. A copy of the insurance policy coverage must be on the premises and readily available for review, and the correct location must be shown.
10. A minimum of one 2A:10BC rating or higher fire extinguisher must be in the stand, readily available and in plain view.
11. All fireworks must have the California State Fire Marshal's Seal for "Safe and Sane" fireworks on each product.
12. At least two "No Smoking" signs must be posted.
13. An age limit sign stating "at least 16 years-old to purchase fireworks" must be posted.
14. The stand must be secure so that the public does not have direct access to any fireworks.
15. Use of fireworks in any manner which might be detrimental to the health, safety and welfare of any person is prohibited.

F. Appendix Section 103.1 General, is amended by the addition of the following: The fees for services performed by the Fire Department in carrying out its responsibilities under this code shall be as indicated in the City of Gridley Master Fee Schedule.
G. Appendix Section 108 Board of Appeals, is hereby amended as follows: The Board of Appeals which is the subject of this section shall be the same body as established in Section 15.04.100 of this chapter. The regulations adopted by said Board shall apply to all appeals under the California Fire Code.
H. Appendix Section 109.3 Violation penalties. Delete Section 109.3 and replace with the following: Violation Penalties. Any person who violates any provision of this chapter or said California Fire Code, or fails to comply therewith, or violates or fails to comply with any order made thereunder, or who builds in violation of any detailed statement or specification or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who fails to comply with such an order as affirmed or modified by a court of competent jurisdiction, within the time fixed herein, shall separately for each and every such violation and noncompliance, respectively, be guilty of an infraction and shall be punishable as provided in Chapter 1.09 of the Gridley Municipal Code. Exception: Those sections of the California Fire Code, which have been adopted by the State of California, shall be a misdemeanor and shall be punishable in accordance with Section 1.08.030.
