Burning of all kinds shall be prohibited in the business district of the city. The "business district of the city" is defined as that area which contains any retail or wholesale business establishment. Any owner of real property or lessee thereof, or other person or persons in legal possession of a premises located in the business district who is physically present on the premises at such time as a violation of this section is being committed shall be deemed to have permitted the burning and shall be deemed to be in violation of this chapter.
