A. No person, firm or corporation shall burn any litter, brush, or leaves in the streets or gutters of the city.
B. No person, firm or corporation shall burn any debris, litter, leaves, weeds, or other substance, any place in the city, except as follows: during the time of year when daylight saving is in effect the burning hours shall be from six a.m. to seven p.m. At all other times of the year, the burning hours shall be from eight a.m. to five p.m. No burning shall be done at any place, on private property or otherwise, unless there is a cleared area of at least five feet from the exterior boundaries of such fire.
C. No owner of real property, or lessee thereof, or other person or persons in legal possession of the premises or residing thereon, shall permit any burning in violation of this section. If the owner, or lessee, or other person in legal possession or residing thereon is physically present on the premises while a fire is burning in violation of this section or any other section of this chapter, the person shall be deemed to be in violation of this chapter whether or not the person started the fire.
D. It is unlawful to burn any weeds, litter, brush, or debris within the city even within the time limited in this section, during any season when there is an extreme fire hazard and during which time burning permits are required, such burning permits to be issued by the fire chief.
